{"id":2471,"date":"2023-09-02T12:12:49","date_gmt":"2023-09-02T12:12:49","guid":{"rendered":"https:\/\/avhandeyetik.com\/?p=2471"},"modified":"2023-09-02T12:12:50","modified_gmt":"2023-09-02T12:12:50","slug":"istifa-eden-isci-kidem-tazminati-alabilir-mi","status":"publish","type":"post","link":"https:\/\/avhandeyetik.com\/?p=2471","title":{"rendered":"\u0130stifa Eden \u0130\u015f\u00e7i K\u0131dem Tazminat\u0131 Alabilir Mi?"},"content":{"rendered":"\n<p>\u2728KURAL OLARAK i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in i\u015f ili\u015fkisinin i\u015fveren taraf\u0131ndan feshedilmesi halinde ge\u00e7erli bir nedene dayan\u0131larak sona erdirilmesi veya i\u015f\u00e7i taraf\u0131ndan feshedilmesi halinde ise ge\u00e7erli veya hakl\u0131 bir nedene dayan\u0131larak sona erdirilmesi gerekmektedir.<\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131na hak kazanabilme ko\u015fullar\u0131ndan k\u0131saca bahsetmek gerekirse;<\/p>\n\n\n\n<p> 1-) 4857 Say\u0131l\u0131 kanuna tabi i\u015f\u00e7i olmas\u0131,<\/p>\n\n\n\n<p> 2-)\u0130\u015f\u00e7inin i\u015ften ayr\u0131lmadan \u00f6nce en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131<\/p>\n\n\n\n<p> 3-) \u0130\u015f akdinin emeklilik, hakl\u0131 neden, \u00f6l\u00fcm gibi belirli nedenlerle sona ermesi.<\/p>\n\n\n\n<p>\u2728Bu kapsamda i\u015f\u00e7inin istifa etmesi halinde de normal \u015fartlar alt\u0131nda k\u0131dem tazminat\u0131na hak kazanmas\u0131 s\u00f6z konusu de\u011fildir. Ancak uygulamada i\u015fverenin i\u015f\u00e7iye bask\u0131 veya tehdit uygulad\u0131\u011f\u0131 ve i\u015f\u00e7inin istifa dilek\u00e7esi vermesini istedi\u011fi haller s\u00f6z konusu olabilmektedir. Bu gibi istisnai durumlarda Yarg\u0131tay, i\u015f\u00e7i lehine yorum ilkesi gere\u011fi, i\u015f\u00e7inin istifa etmesi halinde dahi k\u0131dem tazminat\u0131na hak kazanabilece\u011fini h\u00fck\u00fcm alt\u0131na almaktad\u0131r. Bu hallerde i\u015fveren genellikle i\u015f\u00e7iye tazminatlar\u0131n\u0131n derhal \u00f6denece\u011fi s\u00f6z\u00fcn\u00fc vererek ya da bask\u0131larla veya tehditle i\u015f\u00e7iden yaz\u0131l\u0131 bir istifa dilek\u00e7esi ister, i\u015f\u00e7i de i\u015f\u00e7i-i\u015fveren ili\u015fkisinin zay\u0131f taraf\u0131 olmas\u0131n\u0131n sonucu olarak i\u015fverenin bu talebini yerine getirse de k\u0131dem tazminat\u0131na kavu\u015famayabilir. Yarg\u0131tay 9. Hukuk Dairesi&#8217;nin 2017\/3428 E. ve 2018\/3442 K. Say\u0131l\u0131 karar\u0131nda i\u015fverenin i\u015f\u00e7iye istifa dilek\u00e7esi vermesi i\u00e7in bask\u0131 uygulamas\u0131, yani i\u015f\u00e7inin iradesini fesada u\u011fratmas\u0131 sonucu d\u00fczenlenen istifa dilek\u00e7esine ger\u00e7ek anlamda istifa olarak de\u011fer verilmedi\u011fi g\u00f6r\u00fclmektedir. \u0130\u015f\u00e7inin iradesinin b\u00f6yle fesada u\u011frat\u0131ld\u0131\u011f\u0131 hallerde i\u015f\u00e7inin el yaz\u0131s\u0131 ile istifa dilek\u00e7esi vermesine ra\u011fmen ortada ger\u00e7ek bir istifa iradesi bulunmad\u0131\u011f\u0131, dolay\u0131s\u0131yla feshin i\u015fverence ger\u00e7ekle\u015ftirildi\u011fi kabul edilmektedir. B\u00f6yle bir durumda i\u015fveren feshinin hakl\u0131 olup olmad\u0131\u011f\u0131 de\u011ferlendirilecektir. Bu gibi hallerde i\u015fverenin bask\u0131 uygulamas\u0131 sonucu d\u00fczenlenen istifa dilek\u00e7esine de\u011fer verilemeyece\u011fi, bu gibi hallerde feshin i\u015fverence ger\u00e7ekle\u015ftirildi\u011finin kabul\u00fc gerekece\u011fi ve i\u015fveren feshinin hakl\u0131 olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekti\u011fi kabul edilmektedir.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 9. Hukuk Dairesi 2017\/3428 E. ve 2018\/3442 K. Say\u0131l\u0131 Karar\u0131<\/strong><\/p>\n\n\n\n<p><strong>&#8220;\u0130\u00e7tihat Metni&#8221;<\/strong><\/p>\n\n\n\n<p>MAHKEMES\u0130 :ASL\u0130YE HUKUK MAHKEMES\u0130<br>DAVA : Davac\u0131, k\u0131dem tazminat\u0131 ile fazla mesai \u00fccreti, hafta tatili \u00e7al\u0131\u015fma \u00fccreti, ulusal bayram ve genel tatil \u00e7al\u0131\u015fma \u00fccreti ve y\u0131ll\u0131k izin \u00fccreti alacaklar\u0131n\u0131n \u00f6detilmesine karar verilmesini istemi\u015ftir.<br>Yerel mahkemece, davan\u0131n k\u0131smen kabul\u00fcne karar verilmi\u015ftir.<br>H\u00fck\u00fcm s\u00fcresi i\u00e7inde taraflar avukatlar\u0131nca temyiz edilmi\u015f olmakla, dava dosyas\u0131 i\u00e7in Tetkik Hakimi taraf\u0131ndan d\u00fczenlenen rapor dinlendikten sonra dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br>Y A R G I T A Y K A R A R I<br>A) Davac\u0131 \u0130steminin \u00d6zeti:<br>Davac\u0131 vekili, m\u00fcvekkilinin daval\u0131 &#8230; Belediye Ba\u015fkanl\u0131\u011f\u0131 hizmetinde \u00e7al\u0131\u015f\u0131rken 16\/05\/2014 tarihinde i\u015f akdinin sona erdi\u011fini, m\u00fcvekkilinin siyasi g\u00f6r\u00fc\u015fleri y\u00fcz\u00fcnden yerel se\u00e7im sonras\u0131nda i\u015ften \u00e7\u0131kmaya zorland\u0131\u011f\u0131n\u0131, i\u015f\u00e7ilik alacaklar\u0131n\u0131 almak i\u00e7in kendilerine zorla imzalatt\u0131r\u0131lan belgeler ile i\u015ften ayr\u0131lmak zorunda b\u0131rak\u0131ld\u0131\u011f\u0131n\u0131, di\u011fer daval\u0131 &#8230; \u0130n\u015faat Ltd \u015eirketinin Belediyenin alt i\u015fvereni konumunda oldu\u011funu, m\u00fcvekkilinin &#8230; \u0130n\u015faat Ltd \u015eirketi b\u00fcnyesinde Belediye hizmetinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 iddia ederek fazlaya ili\u015fkin haklar sakl\u0131 kalmak \u00fczere k\u0131dem tazminat\u0131 ile fazla mesai \u00fccreti, hafta tatili \u00e7al\u0131\u015fma \u00fccreti, ulusal bayram ve genel tatil \u00e7al\u0131\u015fma \u00fccreti ve y\u0131ll\u0131k izin \u00fccretinin yasal faizi ile birlikte daval\u0131lardan m\u00fc\u015ftereken ve m\u00fcteselsilen tahsilini talep etmi\u015ftir.<br>B) Daval\u0131lar\u0131n Cevab\u0131n\u0131n \u00d6zeti:<br>Daval\u0131 &#8230; \u0130n\u015faat Ltd \u015firketi vekili ;davac\u0131n\u0131n yan\u0131nda \u00e7al\u0131\u015fmad\u0131\u011f\u0131 d\u00f6nemde m\u00fcvekkilinin sorumlulu\u011funun bulunmad\u0131\u011f\u0131n\u0131, m\u00fcvekkilinin alt i\u015fveren olmad\u0131\u011f\u0131 ve kayna\u011f\u0131 m\u00fcvekkiline verilmeyen alacak kalemlerinde \u015firketin sorumlu olmayaca\u011f\u0131n\u0131 savunarak i\u015f\u00e7i alacaklar\u0131n\u0131n muhatab\u0131n\u0131n belediye oldu\u011funu, bu nedenlerle davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<br>Daval\u0131 &#8230; Belediye Ba\u015fkanl\u0131\u011f\u0131 vekili ;m\u00fcvekkili belediyenin hizmet y\u00fcklenim s\u00f6zle\u015fmesi yapt\u0131\u011f\u0131,hizmet al\u0131m s\u00f6zle\u015fmesine g\u00f6re t\u00fcm hak ve alacaklar\u0131n\u0131n &#8230; \u0130n\u015faat sorumlulu\u011funda oldu\u011fu ve onlar\u0131n taraf\u0131ndan \u00f6dendi\u011fi, davac\u0131n\u0131n fazla \u00e7al\u0131\u015fmas\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n i\u015f akdinin &#8230; \u0130n\u015faat \u015firketi taraf\u0131ndan sonland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n talep etti\u011fi alacaklar\u0131n zaman a\u015f\u0131m\u0131na u\u011frad\u0131\u011f\u0131n\u0131 savunarak davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<br>C) Yerel Mahkeme Karar\u0131n\u0131n \u00d6zeti:<br>Mahkemece, toplanan kan\u0131tlar ve bilirki\u015fi raporuna dayan\u0131larak davan\u0131n k\u0131smen kabul\u00fcne karar verilmi\u015ftir.<br>D) Temyiz:<br>Karar\u0131 taraflar vekilleri temyiz etmi\u015ftir.<br>E) Gerek\u00e7e:<br>1- Dosyadaki yaz\u0131lara, toplanan delillerle karar\u0131n dayand\u0131\u011f\u0131 kanuni gerektirici sebeplere g\u00f6re daval\u0131lar\u0131n t\u00fcm, davac\u0131n\u0131n a\u015fa\u011f\u0131daki bentlerin kapsam\u0131 d\u0131\u015f\u0131nda kalan temyiz itirazlar\u0131 yerinde de\u011fildir.<br>2- Taraflar aras\u0131ndaki uyu\u015fmazl\u0131k, davac\u0131n\u0131n k\u0131dem tazminat\u0131na hak kazan\u0131p kazanmad\u0131\u011f\u0131 ve i\u015f ili\u015fkisinin i\u015f\u00e7inin istifas\u0131 ile sona erip ermedi\u011fi konusunda toplanmaktad\u0131r.<br>Genel olarak i\u015f s\u00f6zle\u015fmesini fesih hakk\u0131, kar\u015f\u0131 tarafa y\u00f6neltilmesi gereken tek tarafl\u0131 bir irade beyan\u0131 ile i\u015f s\u00f6zle\u015fmesini derhal veya belirli bir s\u00fcrenin ge\u00e7mesiyle ortadan kald\u0131rabilme yetkisi veren, bozucu yenilik do\u011furan bir hakt\u0131r. \u0130\u015f\u00e7inin hakl\u0131 nedenle i\u015f s\u00f6zle\u015fmesini derhal feshi 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 24\u2019\u00fcnc\u00fc maddesinde d\u00fczenlenmi\u015ftir. \u0130\u015f\u00e7inin \u00f6nelli fesih bildiriminin normatif d\u00fczenlemesi ise ayn\u0131 yasan\u0131n 17\u2019nci maddesinde ele al\u0131nm\u0131\u015ft\u0131r. Bunun d\u0131\u015f\u0131nda Yasada i\u015f\u00e7inin istifas\u0131 \u00f6zel olarak d\u00fczenlenmi\u015f de\u011fildir.<br>\u0130\u015f\u00e7inin hakl\u0131 bir nedene dayanmadan ve bildirim \u00f6neli tan\u0131maks\u0131z\u0131n i\u015f s\u00f6zle\u015fmesini feshi, istifa olarak de\u011ferlendirilmelidir. \u0130stifa iradesinin kar\u015f\u0131 tarafa ula\u015fmas\u0131yla birlikte i\u015f ili\u015fkisi sona erer.<br>\u0130stifan\u0131n i\u015fverence kabul\u00fc zorunlu de\u011filse de i\u015fverence dilek\u00e7enin i\u015fleme konulmamas\u0131 ve i\u015f\u00e7inin de i\u015fyerinde \u00e7al\u0131\u015fmaya devam etmesi halinde ger\u00e7ek bir istifadan s\u00f6z edilemez. Bununla birlikte istifaya ra\u011fmen taraflar\u0131n belirli bir s\u00fcre daha \u00e7al\u0131\u015fma y\u00f6n\u00fcnde iradelerinin birle\u015fmesi halinde, kararla\u015ft\u0131r\u0131lan s\u00fcrenin sonunda i\u015f s\u00f6zle\u015fmesinin ikale yoluyla sona erdi\u011fi kabul edilmelidir.<br>\u015earta ba\u011fl\u0131 istifa ise kural olarak ge\u00e7erli de\u011fildir. Uygulamada en \u00e7ok kar\u015f\u0131la\u015f\u0131lan \u015fekliyle, i\u015f\u00e7inin ihbar ve k\u0131dem tazminat\u0131 haklar\u0131n\u0131n \u00f6denmesi \u015fart\u0131yla ayr\u0131lma talebi istifa olarak de\u011fil, ikale (bozma s\u00f6zle\u015fmesi) yapma y\u00f6n\u00fcnde bir icap olarak de\u011ferlendirilmelidir.<br>\u0130\u015f\u00e7inin istifa dilek\u00e7esindeki iradesinin fesada u\u011frat\u0131lmas\u0131 da s\u0131k\u00e7a kar\u015f\u0131la\u015f\u0131lan bir durumdur. \u0130\u015fverenin tazminatlar\u0131n derhal \u00f6denece\u011fi s\u00f6z\u00fcn\u00fc vermek ve benzeri bask\u0131larla i\u015f\u00e7iden yaz\u0131l\u0131 istifa dilek\u00e7esi vermesini talep etmesi ve i\u015f\u00e7inin buna uymas\u0131 halinde, ger\u00e7ek bir istifa iradesinden s\u00f6z edilemez. Bu halde feshin i\u015fverence ger\u00e7ekle\u015ftirildi\u011fi kabul edilmelidir.<br>\u0130\u015fverenin bask\u0131 uygulamas\u0131 sonucu d\u00fczenlenen istifa dilek\u00e7esine de\u011fer verilemez. Dairemizce bu gibi hallerde feshin i\u015fverence ger\u00e7ekle\u015ftirildi\u011fi, bununla birlikte i\u015fveren feshinin hakl\u0131 olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekti\u011fi kabul edilmektedir (Yarg\u0131tay 9.HD. 3.7.2007 g\u00fcn 2007\/14407 E, 2007\/21552 K.).<br>\u0130\u015f\u00e7inin hakl\u0131 nedenle derhal fesih nedenleri mevcut oldu\u011fu ve buna uygun bi\u00e7imde bir fesih yoluna gidece\u011fi s\u0131rada, iradesi fesada u\u011frat\u0131larak i\u015fverence istifa dilek\u00e7esi al\u0131nmas\u0131 durumunda da istifaya ge\u00e7erlilik tan\u0131nmas\u0131 do\u011fru olmaz. Bu durumda i\u015f\u00e7inin hakl\u0131 olarak s\u00f6zle\u015fmeyi feshetti\u011fi sonucuna var\u0131lmal\u0131d\u0131r.<br>\u0130stifa belgesine dayan\u0131lmakla birlikte, i\u015f\u00e7iye ihbar ve k\u0131dem tazminatlar\u0131n\u0131n \u00f6denmi\u015f olmas\u0131, T\u00fcrkiye \u0130\u015f Kurumuna yap\u0131lan bildirimde i\u015fveren feshinden s\u00f6z edilmesi gibi \u00e7eli\u015fkili durumlarda, her bir somut olay y\u00f6n\u00fcnden bu \u00e7eli\u015fkinin istifan\u0131n ge\u00e7erlili\u011fine etkisinin de\u011ferlendirilmesi gerekir.<br>\u0130stifa belgesindeki ifadenin genel bir i\u00e7erik ta\u015f\u0131mas\u0131 durumunda, i\u015f\u00e7inin dava dilek\u00e7esinde somut sebepleri belirtmesinde hukuka ayk\u0131r\u0131 bir y\u00f6n bulunmamaktad\u0131r. Bu halde de istifan\u0131n ard\u0131ndaki ger\u00e7ek durum ara\u015ft\u0131r\u0131lmal\u0131d\u0131r.<br>\u0130\u015f s\u00f6zle\u015fmesinin istifa ile sona ermesi halinde, i\u015f\u00e7inin i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanmas\u0131 m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 gibi, ihbar ve k\u0131dem tazminatlar\u0131na da hak kazanamaz. \u0130stifa durumunda i\u015f\u00e7inin i\u015fverene ihbar tazminat\u0131 \u00f6demesi y\u00fck\u00fcm\u00fc ortaya \u00e7\u0131kabilece\u011finden, istifa t\u00fcr\u00fcndeki belgelerin titizlikle ele al\u0131nmas\u0131 gerekir. \u0130mzaya itiraz ya da metin k\u0131sm\u0131na ilaveler yap\u0131ld\u0131\u011f\u0131 itiraz\u0131 mutlak olarak teknik y\u00f6nden incelenmelidir.<br>\u0130stifa halinde dahi i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6denece\u011fini \u00f6ng\u00f6ren s\u00f6zle\u015fme h\u00fck\u00fcmleri ile i\u015fyeri uygulamalar\u0131, 4857 say\u0131l\u0131 Yasaya g\u00f6re ge\u00e7erli olup, bu halde k\u0131dem tazminat\u0131 1475 say\u0131l\u0131 Yasan\u0131n 14\u2019\u00fcnc\u00fc maddesine g\u00f6re hesaplanmal\u0131 ve an\u0131lan maddedeki k\u0131dem tazminat\u0131 tavan\u0131 g\u00f6zetilmelidir. Belirtmek gerekir ki, s\u00f6z\u00fc edilen Yasada d\u00fczenlenen k\u0131dem tazminat\u0131 tavan\u0131 mutlak emredici niteliktedir.<br>Di\u011fer taraftan istifa iradesinin a\u00e7\u0131k ve \u015farts\u0131z olarak i\u015f\u00e7i taraf\u0131ndan ortaya konmas\u0131 gerekir. \u0130rade fesad\u0131 halleri istifa neden ile fesihte ileri s\u00fcr\u00fcld\u00fc\u011f\u00fcnde dikkate al\u0131nmal\u0131d\u0131r.<br>Somut uyu\u015fmazl\u0131kta, davac\u0131 i\u015f s\u00f6zle\u015fmesinin i\u015fverence haks\u0131z feshedildi\u011fini ileri s\u00fcrm\u00fc\u015f, daval\u0131 ise dosyaya sunulan 24.06.2014 g\u00fcnl\u00fc istifa dilek\u00e7esine dayanarak davac\u0131n\u0131n istifa etti\u011fini savunmu\u015ftur. Daval\u0131 taraf\u0131ndan dosyaya sunulan, davac\u0131 imzal\u0131 24.06.2014 tarihli \u201c\u0130stifa \u201d belgesi matbu olarak haz\u0131rlana d\u00fczenleme tarihi olmayan bir belge olup, bu belgenin ge\u00e7erli kabul edilmesi do\u011fru de\u011fildir.<br>Davac\u0131 i\u015f\u00e7inin hakl\u0131 nedenle derhal fesih nedenleri mevcut olup ve buna uygun bi\u00e7imde bir fesih yoluna gidece\u011fi s\u0131rada,davac\u0131 tan\u0131k anlat\u0131mlar\u0131nda da belirtildi\u011fi \u00fczere iradesinin fesada u\u011frat\u0131larak i\u015fverence istifa dilek\u00e7esi al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan istifaya ge\u00e7erlilik tan\u0131nmas\u0131 yerinde de\u011fildir. Bu durumda i\u015f\u00e7inin hakl\u0131 olarak s\u00f6zle\u015fmeyi feshetti\u011fi sonucuna var\u0131lmal\u0131d\u0131r.<br>\u00d6te yandan, ayn\u0131 mahkemece karara ba\u011flanan ve Dairemizce ayn\u0131 g\u00fcn temyiz incelemesine konu olan ayn\u0131 i\u015f yeri ile ilgili dosyalarda da belediyenin \u00e7e\u015fitli kademelerinde g\u00f6revli olan davac\u0131 i\u015f\u00e7ilerin matbu \u015fekilde , ayn\u0131 ve yak\u0131n tarihte \u201c\u0130stifa \u201d belgesi imzalad\u0131klar\u0131 tespit edilmi\u015f olup bu \u015fekilde ayr\u0131lman\u0131n hayat\u0131n ola\u011fan ak\u0131\u015f\u0131na uygun olmad\u0131\u011f\u0131 da a\u00e7\u0131kt\u0131r.<br>Mahkemece, davac\u0131n\u0131n k\u0131dem tazminat\u0131 talebinin kabul\u00fcne karar verilmesi gerekir.
