Hukuk Dairesi\u2019nin 2013\/693 E, 2013\/30811 K. Say\u0131l\u0131 ve 27.12.2013 tarihli karar\u0131nda, mobbingin varl\u0131\u011f\u0131 i\u00e7in ki\u015filik haklar\u0131n\u0131n a\u011f\u0131r \u015fekilde ihlaline gerek olmad\u0131\u011f\u0131, ki\u015filik haklar\u0131na y\u00f6nelik haks\u0131zl\u0131\u011f\u0131n yeterli oldu\u011fu, ayr\u0131ca mobbing iddialar\u0131nda \u015f\u00fcpheden uzak kesin deliller aranmayaca\u011f\u0131; i\u015f\u00e7inin, kendisine i\u015fyerinde mobbing uyguland\u0131\u011f\u0131na dair ku\u015fku uyand\u0131racak olgular\u0131n ileri s\u00fcrmesinin yeterli oldu\u011fu, i\u015fyerinde mobbing ger\u00e7ekle\u015fmedi\u011fini ispat k\u00fclfetinin i\u015fverene ait oldu\u011fu y\u00f6n\u00fcnde h\u00fck\u00fcm tesis edilmi\u015ftir.<\/p>\n\n\n\n<p>Yarg\u0131tay 22. Say\u0131l\u0131 Karar\u0131:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>MOBB\u0130NG<\/li>\n\n\n\n<li>\u0130\u015e\u00c7\u0130YE PS\u0130KOLOJ\u0130K TAC\u0130Z<\/li>\n\n\n\n<li>\u0130\u015e\u00c7\u0130N\u0130N STRESL\u0130 \u00c7ALI\u015eMA ORTAMINDA BULUNMASI NEDEN\u0130YLE RAHATSIZLANMASI<\/li>\n\n\n\n<li>MOBB\u0130NG GER\u00c7EKLE\u015eMED\u0130\u011e\u0130N\u0130N \u0130SPAT Y\u00dcK\u00dc<\/li>\n\n\n\n<li>\u0130\u015e\u00c7\u0130N\u0130N UYARI \u0130THAM VE KIRICI \u00dcSLUPLARA MARUZ KALMASI<\/li>\n\n\n\n<li>D\u0130\u011eER \u0130\u015e\u00c7\u0130LERDEN SOYUTLANMA<\/li>\n\n\n\n<li>MOBB\u0130NG NEDEN\u0130YLE MANEV\u0130 TAZM\u0130NAT<\/li>\n\n\n\n<li>MOBB\u0130NG\u0130N VARLI\u011eI \u0130\u00c7\u0130N K\u0130\u015e\u0130L\u0130K HAKLARININ A\u011eIR \u015eEK\u0130LDE \u0130HLAL\u0130NE GEREK OLMADI\u011eI, K\u0130\u015e\u0130L\u0130K HAKLARINA Y\u00d6NEL\u0130K HAKSIZLI\u011eIN YETERL\u0130 OLDU\u011eU<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>BOR\u00c7LAR KANUNU(M\u00dcLGA) (818) Madde 49<\/li>\n\n\n\n<li>T\u00dcRK BOR\u00c7LAR KANUNU (6098) Madde 56<\/li>\n<\/ul>\n\n\n\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n\n\n\n<p>&nbsp;Davac\u0131 vekili m\u00fcvekkilinin 1994-17.12.2010 tarihleri aras\u0131nda daval\u0131 i\u015fyerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, i\u015f s\u00f6zle\u015fmesinin haks\u0131z olarak feshedildi\u011fini a\u00e7\u0131lan i\u015fe iade davas\u0131n\u0131n kabul edildi\u011fini temyiz a\u015famas\u0131nda oldu\u011funu, g\u00fcnl\u00fck 12-13 saat \u00e7al\u0131\u015fmas\u0131na ra\u011fmen fazla mesai alacaklar\u0131n\u0131n \u00f6denmedi\u011fini, i\u015fyerinde mobbinge maruz kald\u0131\u011f\u0131n\u0131 belirterek manevi tazminat ve fazla mesai alaca\u011f\u0131n\u0131n \u00f6detilmesine karar verilmesini talep etmi\u015ftir.<\/p>\n\n\n\n<p>Daval\u0131 vekili, davac\u0131n\u0131n \u00fccretine fazla mesainin dahil oldu\u011funu, personelle s\u0131k s\u0131k tart\u0131\u015ft\u0131\u011f\u0131n\u0131, yaz\u0131l\u0131 olarak iki defa uyar\u0131ld\u0131\u011f\u0131n\u0131, \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u015fubede verimli olmamas\u0131 nedeniyle \u015fubesinin de\u011fi\u015ftirildi\u011fini ve bu nedenle i\u015f s\u00f6zle\u015fmesinin feshedildi\u011fini belirterek davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<\/p>\n\n\n\n<p>Mahkeme, dosyada bulunan davac\u0131 ve daval\u0131 tan\u0131k anlat\u0131mlar\u0131 ile mevcut di\u011fer delillerin birlikte de\u011ferlendirilmesinden davac\u0131ya sistematik ve s\u00fcrekli psikolojik bask\u0131 uyguland\u0131\u011f\u0131n\u0131 g\u00f6sterir kuvvetli deliller bulunmad\u0131\u011f\u0131, ki\u015filik haklar\u0131 veya sa\u011fl\u0131\u011f\u0131n\u0131n sistematik ve a\u011f\u0131r bir sald\u0131r\u0131ya u\u011frad\u0131\u011f\u0131 y\u00f6n\u00fcn\u00fcn ku\u015fkudan uzak delillerle yeterince ortaya konulmad\u0131\u011f\u0131 kanaatiyle davan\u0131n reddine karar vermi\u015ftir.<\/p>\n\n\n\n<p>H\u00fck\u00fcm davac\u0131 vekilince temyiz edilmi\u015ftir.<\/p>\n\n\n\n<p>1-Dosyadaki yaz\u0131lara toplanan delillerle karar\u0131n dayand\u0131\u011f\u0131 kanuni gerektirici sebeplere g\u00f6re, davac\u0131n\u0131n a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131nda kalan temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n\n\n\n<p>2-Daval\u0131 i\u015fyeri \u00e7al\u0131\u015fanlar\u0131ndan \u015e. \u00c7. \u00dc.\u2019n\u00fcn davac\u0131ya sinirli tav\u0131rlar g\u00f6sterip elinde bulunan k\u00e2\u011f\u0131tlar\u0131 ve zarf\u0131 davac\u0131n\u0131n masas\u0131na ve \u00fczerine f\u0131rlatt\u0131\u011f\u0131, bir s\u00fcre sonra s\u00f6zkonusu belgeleri geri al\u0131p sinirli tav\u0131rlar sergiledikten sonra tekrar masaya f\u0131rlatt\u0131\u011f\u0131, davac\u0131n\u0131n yere d\u00fc\u015fen belgeleri toplad\u0131\u011f\u0131, davac\u0131n\u0131n bireysel pazarlama yetkilisi olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u0131rada cari hesaplar yetkilisi olan G. B. \u00c7.\u2019in davac\u0131n\u0131n yerine g\u00f6revlendirildi\u011fi, davac\u0131n\u0131n bu g\u00f6rev de\u011fi\u015fikli\u011fi nedeniyle ma\u011fdur oldu\u011fu d\u00fc\u015f\u00fcncesine kap\u0131ld\u0131\u011f\u0131 ve hastaland\u0131\u011f\u0131, davac\u0131n\u0131n bankac\u0131l\u0131k i\u015flemleri konusunda kurallara uygun hareket etmek istedi\u011fi, bu nedenle amirleri ile sorunlar ya\u015fad\u0131\u011f\u0131, uyar\u0131, itham ve k\u0131r\u0131c\u0131 \u00fcsluplarla bask\u0131lara maruz kald\u0131\u011f\u0131, banka m\u00fcd\u00fcr\u00fc taraf\u0131ndan sorun \u00e7\u0131karan, uyumsuz, sevilmeyen ve kavgac\u0131 biri olarak su\u00e7land\u0131\u011f\u0131, s\u00fcre\u00e7 i\u00e7inde davac\u0131ya y\u00f6nelik bu ve benzeri olumsuz davran\u0131\u015flar\u0131n tekrarland\u0131\u011f\u0131, bir ba\u015fka personelin yapmas\u0131 gereken i\u015flerin s\u0131k s\u0131k davac\u0131ya verildi\u011fi, banka m\u00fcd\u00fcr\u00fc taraf\u0131ndan cumartesi g\u00fcnleri mesai yapt\u0131r\u0131ld\u0131\u011f\u0131, i\u015fyerinde d\u00fczenli bir \u00e7al\u0131\u015fma \u015feklinin olmad\u0131\u011f\u0131, davac\u0131yla ayn\u0131 pozisyonda olan di\u011fer \u00e7al\u0131\u015fanlara anahtar ve \u015fifreler verildi\u011fi halde davac\u0131ya verilmedi\u011fi, davac\u0131n\u0131n stresli \u00e7al\u0131\u015fma ortam\u0131nda bulunman\u0131n da etkisiyle sindirim sistemi rahats\u0131zl\u0131\u011f\u0131 \u00e7ekti\u011fi, banka \u015fubesinin yap\u0131lan i\u00e7 denetimde d\u00fc\u015f\u00fck performans g\u00f6sterdi\u011finin belirlendi\u011fi, davac\u0131n\u0131n i\u015fyeri i\u00e7indeki di\u011fer \u00e7al\u0131\u015fanlardan soyutland\u0131\u011f\u0131, son d\u00f6rt ay i\u00e7inde yirmi\u015fer g\u00fcnl\u00fck sa\u011fl\u0131k raporlar\u0131 ald\u0131\u011f\u0131, son bir y\u0131l i\u00e7inde pe\u015f pe\u015fe disiplin soru\u015fturmalar\u0131 ge\u00e7irerek kendisinden savunmalar istendi\u011fi, \u015fube i\u00e7i elektronik posta ile yap\u0131lan yaz\u0131\u015fmalarda \u201cdensiz\u201d denilmek suretiyle hakarete maruz kald\u0131\u011f\u0131, yap\u0131lan yaz\u0131\u015fmalarda nezaket s\u0131n\u0131rlar\u0131n\u0131n a\u015f\u0131ld\u0131\u011f\u0131, davac\u0131n\u0131n ya\u015fam\u0131\u015f oldu\u011fu olumsuzluklar\u0131 i\u015fyerindeki amirine iletti\u011fi halde sorunlara \u00e7\u00f6z\u00fcm getirilmedi\u011fi ve kendisinde kusur bulundu\u011fu, ya\u015fan\u0131lan olumsuzluklar sonunda anksiyete bozuklu\u011fu \u00e7ekti\u011fi ve sa\u011fl\u0131k sorunlar\u0131yla u\u011fra\u015ft\u0131\u011f\u0131, bir y\u0131ll\u0131k maa\u015f art\u0131\u015f\u0131n\u0131n yaln\u0131zca 1,96 olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc; davac\u0131n\u0131n i\u015fyerinde ya\u015fad\u0131klar\u0131n\u0131 \u201cOlaylar\u201d ba\u015fl\u0131\u011f\u0131 alt\u0131nda kaleme ald\u0131\u011f\u0131, s\u00f6zkonusu yaz\u0131da tutarl\u0131l\u0131k, samimiyet ve iddia edilen hususlarla bir b\u00fct\u00fcnl\u00fck g\u00f6r\u00fcld\u00fc\u011f\u00fc, bu hususlar\u0131n mobbing te\u015fkil etti\u011fi t\u00fcm dosya i\u00e7eri\u011finden anla\u015f\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Mobbinging varl\u0131\u011f\u0131 i\u00e7in ki\u015filik haklar\u0131n\u0131n a\u011f\u0131r \u015fekilde ihlaline gerek olmad\u0131\u011f\u0131, ki\u015filik haklar\u0131na y\u00f6nelik haks\u0131zl\u0131\u011f\u0131n yeterli oldu\u011fu, ayr\u0131ca mobbing iddialar\u0131nda \u015f\u00fcpheden uzak kesin deliller aranmayaca\u011f\u0131; davac\u0131 i\u015f\u00e7inin, kendisine i\u015fyerinde mobbing uyguland\u0131\u011f\u0131na dair ku\u015fku uyand\u0131racak olgular\u0131n ileri s\u00fcrmesinin yeterli oldu\u011fu, i\u015fyerinde mobbing ger\u00e7ekle\u015fmedi\u011fini ispat k\u00fclfetinin daval\u0131ya d\u00fc\u015ft\u00fc\u011f\u00fc; tan\u0131k beyanlar\u0131, sa\u011fl\u0131k raporlar\u0131, bilirki\u015fi raporu, kamera kay\u0131tlar\u0131 ve di\u011fer t\u00fcm deliller de\u011ferlendirildi\u011finde mobbing iddas\u0131n\u0131n yeterli delillerle ispat edildi\u011fi g\u00f6zetilmeden yaz\u0131l\u0131 \u015fekilde karar verilmesi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.<\/p>\n\n\n\n<p><strong>SONU\u00c7:&nbsp;<\/strong>Temyiz olunan karar\u0131n yukar\u0131da yaz\u0131l\u0131 sebepten BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde ilgiliye iadesine, 27.12.2013 g\u00fcn\u00fcnde oy\u00e7oklu\u011fuyla karar verildi.<\/p>\n\n\n\n<p><strong>KAR\u015eI OY<\/strong><\/p>\n\n\n\n<p>Dosya i\u00e7eri\u011fine ve \u00f6zellikle taraf tan\u0131klar\u0131n\u0131n anlat\u0131mlar\u0131na g\u00f6re; davac\u0131n\u0131n i\u015f ortam\u0131nda \u00e7al\u0131\u015fma arkada\u015flar\u0131yla gerekli uyumu sa\u011flayamad\u0131\u011f\u0131, di\u011fer \u00e7al\u0131\u015fanlarla i\u015fbirli\u011fi yapmaktan ka\u00e7\u0131nd\u0131\u011f\u0131, i\u015fyerinde zaman zaman amirleri ve di\u011fer \u00e7al\u0131\u015fanlarla i\u015fin y\u00fcr\u00fct\u00fcm\u00fcnden kaynaklanan nedenlerle tart\u0131\u015ft\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Davac\u0131n\u0131n i\u015fin y\u00fcr\u00fct\u00fcm\u00fc bak\u0131m\u0131ndan olumsuzluklara yol a\u00e7an tutum ve davran\u0131\u015flar\u0131ndan kaynaklanan tart\u0131\u015fmalar\u0131n psikolojik taciz (mobing) olarak nitelendirilmesi m\u00fcmk\u00fcn de\u011fildir. Davac\u0131n\u0131n hedef ki\u015fi olarak \u015fe\u00e7ilip kendisine kar\u015f\u0131 sistematik bir bi\u00e7imde y\u0131ld\u0131rma hareketlerinin yap\u0131ld\u0131\u011f\u0131na dair delil bulunmamaktad\u0131r.
