A.. hakk\u0131nda Ala\u015fehir Trafik Denetleme Birim Amirli\u011finin 27\/05\/2013 tarihli ve GT-525573 say\u0131l\u0131 idari para cezas\u0131 karar tutana\u011f\u0131 ile uygulanan 343,00 T\u00fcrk liras\u0131 idari para cezas\u0131na y\u00f6nelik ba\u015fvurunun kabul\u00fc ile idari para cezas\u0131 karar tutana\u011f\u0131n\u0131n iptaline dair Ala\u015fehir Sulh Ceza Mahkemesinin 05\/07\/2013 tarihli ve 2013\/493 de\u011fi\u015fik i\u015f say\u0131l\u0131 karar\u0131n\u0131 kapsayan dosya incelendi.<br>Ala\u015fehir Sulh Ceza Mahkemesince, radar kontrol\u00fc yap\u0131lan yerde radar i\u015faretinin bulunmad\u0131\u011f\u0131, gerekli yasal uyar\u0131lar usul\u00fcne uygun \u015fekilde yap\u0131lmadan kesilen para cezalar\u0131n\u0131n hukuki mesnedinin bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle muteriz hakk\u0131ndaki idari para cezas\u0131n\u0131n iptaline karar verilmi\u015f ise de;<br>\u201c2918 say\u0131l\u0131 Karayollar\u0131 Trafik Kanunu\u2019nun \u201cH\u0131z s\u0131n\u0131rlar\u0131\u201d ba\u015fl\u0131kl\u0131 50. maddesinin 3 ve 4. f\u0131kralar\u0131nda yer alan, \u201c (3) En \u00e7ok ve en az h\u0131z s\u0131n\u0131rlar\u0131n\u0131 g\u00f6steren i\u015faret levhalar\u0131, gerekli g\u00f6r\u00fclen yerlere, ilgili kurulu\u015flarca konulur. (4) Bu Kanunla yetki verilen kurulu\u015flar taraf\u0131ndan y\u00f6netmelikte belirtilen h\u0131z s\u0131n\u0131rlar\u0131 yol ve trafik durumuna g\u00f6re azalt\u0131labilir veya \u00e7o\u011falt\u0131labilir. Bu hallerde durum trafik i\u015faretleri ile belirtilir ve uygun vas\u0131talarla duyurulur.\u201d \u015feklindeki ve ayn\u0131 Kanun\u2019un \u201cH\u0131z s\u0131n\u0131rlar\u0131na uyma\u201d ba\u015fl\u0131kl\u0131 51. maddesinin 1 ve 2. f\u0131kralar\u0131nda yer alan, \u201c(1) S\u00fcr\u00fcc\u00fcler, aksine bir karar al\u0131n\u0131p i\u015faretlenmemi\u015fse y\u00f6netmelikte belirtilen h\u0131z s\u0131n\u0131rlar\u0131n\u0131 a\u015fmamak zorundad\u0131rlar. (2) (De\u011fi\u015fik f\u0131kra: 08\/01\/2003 &#8211; 4785 S.K.\/4. md.) H\u0131z \u00f6l\u00e7en teknik cihaz veya \u00e7e\u015fitli teknik usullerle yap\u0131lan tespit sonucu h\u0131z s\u0131n\u0131rlar\u0131n\u0131 y\u00fczde ondan y\u00fczde otuza (otuz dahil) kadar a\u015fan s\u00fcr\u00fcc\u00fclere 64 700 000 lira, y\u00fczde otuzdan fazla a\u015fan s\u00fcr\u00fcc\u00fclere 131 900 000 lira para cezas\u0131 uygulan\u0131r.\u201d \u015feklindeki d\u00fczenlemeler ile yine bu Kanun\u2019a dayan\u0131larak \u00e7\u0131kar\u0131lan Karayollar\u0131 Trafik Y\u00f6netmeli\u011finin \u201cH\u0131z s\u0131n\u0131rlar\u0131\u201d ba\u015fl\u0131kl\u0131 100. maddesinin 1. f\u0131kras\u0131nda yer alan, \u201c(De\u011fi\u015fik madde:01.09.2010 &#8211; 27689 S.R.G. Y\u00f6n.\/ll.mad)<br>Karayollar\u0131 Trafik Kanununda ve bu Y\u00f6netmelikte yaz\u0131l\u0131 kay\u0131t ve \u015fartlar d\u0131\u015f\u0131nda ve aksine bir i\u015faret bulunmad\u0131k\u00e7a yol durumlar\u0131na g\u00f6re r\u00f6morksuz ara\u00e7 cinsleri i\u00e7in saatteki asgari ve azami h\u0131z s\u0131n\u0131rlar\u0131 a\u015fa\u011f\u0131da g\u00f6sterilmi\u015ftir.\u201d bi\u00e7imindeki d\u00fczenleme ve ayn\u0131 Y\u00f6netmeli\u011fin \u201cH\u0131z s\u0131n\u0131rlar\u0131na uyma ve h\u0131z\u0131n gerekli \u015fartlara uygunlu\u011funu sa\u011flama\u201d ba\u015fl\u0131kl\u0131 101. maddesinin 1, 2 ve 6. f\u0131kralar\u0131nda yer alan, \u201c(1) S\u00fcr\u00fcc\u00fcler aksine bir karar al\u0131n\u0131p i\u015faretlenmemi\u015fse bu Y\u00f6netmeli\u011fin 100 \u00fcnc\u00fc maddesinde belirtilen h\u0131z s\u0131n\u0131rlar\u0131n\u0131 a\u015fmamak zorundad\u0131rlar. (2) Ara\u00e7 s\u00fcr\u00fcl\u00fcrken yap\u0131lan h\u0131z, radar ve benzeri teknik cihazlarla \u00f6l\u00e7\u00fclebilece\u011fi gibi kronometre veya de\u011fi\u015fik usullerle de \u00f6l\u00e7\u00fclerek tespit edilebilir. (6) H\u0131z tahdidini belirleyen aksine bir i\u015faret bulunmayan yerle\u015fim birimleri i\u00e7inden veya civar\u0131ndan ge\u00e7en \u015fehird\u0131\u015f\u0131 karayollar\u0131n\u0131n bu kesimlerinde, can ve mal g\u00fcvenli\u011fi a\u00e7\u0131smdan, kar\u015f\u0131dan kar\u015f\u0131ya ge\u00e7i\u015fler bir fiziki engelle yasaklanm\u0131\u015f veya alt ve \u00fcst ge\u00e7itlerle belirlenmi\u015f ise ve h\u0131z yapmak yaya ve ta\u015f\u0131t trafi\u011fi a\u00e7\u0131s\u0131ndan bir engel te\u015fkil etmiyorsa, ta\u015f\u0131t s\u00fcr\u00fcc\u00fcleri yol ve trafik durumunu dikkate alarak y\u00f6netmeli\u011fin kendilerine tayin etmi\u015f oldu\u011fu azami h\u0131z s\u0131n\u0131rlar\u0131 i\u00e7erisinde seyredeb&#8217;ilirler.\u201d \u015feklindeki d\u00fczenleme dikkate al\u0131nd\u0131\u011f\u0131nda, ne 2918 say\u0131l\u0131 Karayollar\u0131 Trafik K\u00e2nunu\u2019nda ne de Karayollar\u0131 Trafik Y\u00f6netmeli\u011fi\u2019nde radarla h\u0131z denetimi yap\u0131lacak yerlerde denetim yap\u0131ld\u0131\u011f\u0131na dair ikaz levhas\u0131 ve i\u015faretleme bulundurulmas\u0131na ili\u015fkin herhangi bir h\u00fck\u00fcm bulunmad\u0131\u011f\u0131, yukar\u0131da izah edilmeye \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131 \u00fczere aksine bir karar al\u0131n\u0131p i\u015faretleme yap\u0131lmad\u0131k\u00e7a s\u00fcr\u00fcc\u00fclerin y\u00f6netmelikle belirlenen h\u0131z s\u0131n\u0131rlar\u0131n\u0131 a\u015fmamak zorunda olduklar\u0131, somut olayda muterizin yerle\u015fim yeri i\u00e7erisinde otomobil ara\u00e7lar i\u00e7in belirlenmi\u015f olan 50 km\/saat h\u0131z s\u0131n\u0131r\u0131n\u0131 %10 dan daha fazla a\u015fmak suretiyle 71 km\/saat h\u0131zla gitti\u011finin radar cihaz\u0131 ile tespit edilmi\u015f olunmas\u0131 kar\u015f\u0131s\u0131nda, itiraz\u0131n reddi yerine, yaz\u0131l\u0131 gerek\u00e7eyle kabul\u00fcne karar verilmesinde isabet g\u00f6r\u00fclmemi\u015ftir.<br>5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019nun 309. maddesi uyar\u0131nca Ala\u015fehir Sulh Ceza Mahkemesinin 05\/07\/2013 tarihli ve 2013\/493 de\u011fi\u015fik i\u015f say\u0131l\u0131 karar\u0131n\u0131n bozulmas\u0131n\u0131n istenilmesi arz ve dosya birlikte takdim olunur.\u201d<br>I- Olay :<br>Ala\u015fehir \u0130l\u00e7esi S\u00fcleyman Demirel Caddesi \u00fczerinde g\u00f6revlilerce 27.05.2013 tarihinde radar aletiyle yap\u0131lan h\u0131z kontrol\u00fcnde saat 14.54 de kabahatli F.. A..\u2019n\u0131n h\u0131z limitini a\u015ft\u0131\u011f\u0131 tespit edilmi\u015f ve hakk\u0131nda ayn\u0131 tarihte 525573 seri nolu tutanak ile 343.00 Tl idari para cezas\u0131 uygulanm\u0131\u015ft\u0131r. Kabahatli F\u0131rat bu idari para cezas\u0131n\u0131n iptali i\u00e7in ayn\u0131 g\u00fcn Ala\u015fehir Sulh Ceza Mahkemesine ba\u015fvuruda bulunmu\u015ftur. Sulh Ceza Mahkemesince, yap\u0131lan inceleme sonucunda \u201cMuteriz hakk\u0131nda h\u0131z ihlali sebebiyle idari para cezas\u0131 verildi\u011fi, ancak radar kontrol\u00fc yap\u0131lan yerde radar i\u015faretinin bulunmad\u0131\u011f\u0131, gerekli yasal uyar\u0131lar usul\u00fcne uygun bir \u015fekilde yap\u0131lmadan kesilen para cezalar\u0131n\u0131n hukuki mesnedinin bulunmayaca\u011f\u0131 g\u00f6zetilerek yap\u0131lan itiraz\u0131n hakl\u0131 oldu\u011fu kanaatine var\u0131larak, usul ve yasaya ayk\u0131r\u0131 idari yapt\u0131r\u0131m karar\u0131n\u0131n 5326 say\u0131l\u0131 yasan\u0131n 28\/8-b f\u0131kras\u0131 uyar\u0131nca kald\u0131r\u0131lmas\u0131na dair a\u015fa\u011f\u0131daki \u015fekilde h\u00fck\u00fcm kurmak gerekmi\u015ftir.\u201d \u015eeklindeki gerek\u00e7eyle ba\u015fvuru hakl\u0131 bulunarak idari para cezas\u0131 tutana\u011f\u0131n\u0131n iptaline karar verilmi\u015ftir. Bu karara kar\u015f\u0131, Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn, mahkemenin gerek\u00e7esinin kanuna ayk\u0131r\u0131 oldu\u011funa ili\u015fkin m\u00fcracaat\u0131 \u00fczerine kanun yarar\u0131na bozma talebinde bulunulmu\u015ftur.<br>II- Kanun Yarar\u0131na Bozma Talebine \u0130li\u015fkin Uyu\u015fmazl\u0131\u011f\u0131n Kapsam\u0131:<br>2918 say\u0131l\u0131 Karayollar\u0131 Trafik K\u00e2nunu\u2019nda ne de Karayollar\u0131 Trafik Y\u00f6netmeli\u011finde radarla h\u0131z denetimi yap\u0131lacak yerlerde, bu denetimin yap\u0131ld\u0131\u011f\u0131na dair ikaz levhas\u0131 ve i\u015faretleme bulundurulmas\u0131 konusunda herhangi bir h\u00fck\u00fcm yer almad\u0131\u011f\u0131 halde \u201cradar i\u015faretinin bulunmad\u0131\u011f\u0131 ve gerekli yasal uyar\u0131lar\u0131n usul\u00fcne uygun yap\u0131lmad\u0131\u011f\u0131\u201d gerek\u00e7esiyle \u201cidari yapt\u0131r\u0131m karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131\u201d y\u00f6n\u00fcndeki Mahkeme h\u00fckm\u00fcn\u00fcn kanuna ayk\u0131r\u0131 oldu\u011funa ili\u015fkindir.<br>III- Hukuksal de\u011ferlendirme :<br>Anayasam\u0131z\u0131n 2\u2019nci maddesi h\u00fckm\u00fcne g\u00f6re \u201cT\u00fcrkiye Cumhuriyeti, toplumun huzuru, milli dayan\u0131\u015fma ve adalet anlay\u0131\u015f\u0131 i\u00e7inde, insan haklar\u0131na sayg\u0131l\u0131, Atat\u00fcrk milliyet\u00e7ili\u011fine ba\u011fl\u0131, ba\u015flang\u0131\u00e7ta belirtilen temel ilkelere dayanan, demokratik, laik ve sosyal bir hukuk Devletidir.\u201d Anayasa Mahkemesinin yerle\u015fmi\u015f i\u00e7tihatlar\u0131na g\u00f6re (\u00f6rne\u011fin 27.03.1986-E:85\/31-K:86\/111, 08.11.1991-E:91\/9-K:91\/36 tarihli ve say\u0131l\u0131 kararlar) \u201cHukuk devleti her eylem ve i\u015flemi hukuka uygun, insan haklar\u0131na sayg\u0131 g\u00f6steren, her alanda adaletli bir d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasaya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuku t\u00fcm devlet organlar\u0131na hakim k\u0131lan, Anayasa ve hukukun \u00fcst\u00fcn kurallar\u0131yla kendini ba\u011fl\u0131 say\u0131p yarg\u0131 denetimine a\u00e7\u0131k olan, yasalar\u0131n \u00fcst\u00fcnde yasa koyucunun da bozamayaca\u011f\u0131 temel hukuk ilkeleri ve Anayasa bulundu\u011fu bilincinden uzakla\u015ft\u0131\u011f\u0131nda ge\u00e7ersiz kalaca\u011f\u0131n\u0131 bilen bir devlettir.\u201d<br>K\u0131saca, hukuk devleti \u201cfaaliyetlerinde hukuk kurallar\u0131na ba\u011fl\u0131 olan, vatanda\u015flar\u0131na hukuk\u00ee g\u00fcvenlik sa\u011flayan devlet\u201d demektir.<br>Hukuk devleti, hukuka ba\u011fl\u0131 olan devlet demek oldu\u011funa g\u00f6re, devletin \u00fc\u00e7 erkinden biri olan y\u00fcr\u00fctme organ\u0131n\u0131n da hukuk kurallar\u0131yla ba\u011fl\u0131 bulundu\u011fu ku\u015fkusuzdur.<br>Y\u00fcr\u00fctme organ\u0131 bak\u0131m\u0131ndan, idar\u00ee faaliyetlerinin belirlili\u011fi ve \u00f6nceden bilinebilirli\u011fi zorunludur. Hukuk devletinde idarenin eylem ve i\u015flemlerinin idare edilenler taraf\u0131ndan \u00f6nceden tahmin edilebilir olmas\u0131 gerekir. \u0130dari i\u015flem ve eylemlerde idare bu yetkisini t\u00fcz\u00fck ve y\u00f6netmelik gibi genel kurallarla d\u00fczenlemek ve bu d\u00fczenlemelere uymak zorundad\u0131r. Buna \u201cd\u00fczenli idare ilkesi\u201d denir. Keza, yine idar\u00ee faaliyetlerin belirlili\u011fi ilkesi nedeniyle idarenin, istikrar kazanm\u0131\u015f uygulamalar\u0131ndan vazge\u00e7memesi gerekir.<br>Yine hukuk devleti ilkesi, devletin \u201cki\u015fi hak ve \u00f6zg\u00fcrl\u00fcklerini, kamu d\u00fczen ve g\u00fcvenli\u011fini, kamu sa\u011fl\u0131\u011f\u0131n\u0131 ve \u00e7evreyi, ekonomik d\u00fczeni, toplum bar\u0131\u015f\u0131n\u0131 ve d\u00fczenini, genel ahl\u00e2ka ili\u015fkin kurallar\u0131 ihlal eden eylemleri yani su\u00e7 ve kabahatleri, ulusal ve evrensel hukuk \u00e7er\u00e7evesinde, \u00f6detme g\u00f6rev ve y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. Ancak Devletin, esasen ve \u00f6ncelikle bu kurallar\u0131n ihlalini \u00f6nleme g\u00f6revi bulundu\u011funun kabul\u00fc gerekir. Ba\u015fka bir deyi\u015fle, hukuk devletinin bir erki olan idarenin g\u00f6revi, \u00f6ncelikle bireylerin kurallar\u0131 ihlal etmesini bekleyip cezaland\u0131rma yoluna gitmesi de\u011fil, kurallara uygun davranma d\u00fczeyini ve al\u0131\u015fkanl\u0131\u011f\u0131n\u0131 geli\u015ftirmek olmal\u0131d\u0131r. Bu husus \u201ciyi idare ilkelerinin\u201d de bir gere\u011fidir. Keza idarenin (Y\u00fcr\u00fctmenin) iyi idare ilkeleriyle ba\u011fl\u0131 olmas\u0131 da hukuk devletinin bir gere\u011fidir. Nitekim \u00fclkemizin de \u00fcyesi oldu\u011fu Avrupa Konseyinin Bakanlar Komitesinin 20 Haziran 2007 tarihli ve 999 say\u0131l\u0131 Bakan Temsilcileri toplant\u0131s\u0131nda, \u201c\u0130Y\u0130 \u0130DARE KONUSUNDA \u00dcYE DEVLETLERE CM\/REC(2007)7 SAYILI TAVS\u0130YE KARARI\u201d kabul edilmi\u015ftir.<br>Mezkur Tavsiye Karar\u0131n\u0131n \u201cA\u00e7\u0131kl\u0131k \u0130lkesi\u201d ba\u015fl\u0131kl\u0131 10 uncu maddesinde;<br>\u201c1.\u0130dare a\u00e7\u0131kl\u0131k ilkesine uygun faaliyette bulunur.<br>2.\u0130dare, karar ve i\u015flemlerinden \u00f6zel ki\u015fileri, resmi belgelerin yay\u0131nlanmas\u0131 da dahil olabilecek \u015fekilde uygun ara\u00e7larla haberdar eder.<br>3.Ki\u015fisel verilerin korumas\u0131na ili\u015fkin kurallara uygun olarak resmi belgelere eri\u015fim hakk\u0131n\u0131 tan\u0131r.<br>4. Zaman zaman Dan\u0131\u015ftay, Avrupa Konseyi Bakanlar Komitesi tavsiyelerini, kararlar\u0131nda gerek\u00e7eyi desteklemek i\u00e7in kullanmaktad\u0131r. \u00d6rne\u011fin, bir gazetecinin sar\u0131 bas\u0131n kart\u0131 istemi idarece gerek\u00e7esiz bir i\u015flemle reddedilmi\u015ftir. Ayn\u0131 Kanunun 33 \u00fcnc\u00fc maddesi h\u00fckm\u00fcyle de \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u201ckanunla yerine getirmekle y\u00fck\u00fcml\u00fc olduklar\u0131 hizmetleri; t\u00fcz\u00fck, y\u00f6netmelik, tebli\u011f, genelge ve di\u011fer idari metinlerle d\u00fczenlemek\u201d ile g\u00f6revli ve yetkili k\u0131l\u0131nm\u0131\u015ft\u0131r.<br>\u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131n\u0131n bu \u201cd\u00fczenleme g\u00f6rev ve yetkisi\u201d dahilinde, Trafik Denetimlerinde ve Trafik Kazalar\u0131nda Al\u0131nacak \u00d6nlemlere \u0130li\u015fkin Y\u00f6nerge haz\u0131rlanarak 31.10.2011 tarihli Bakan onay\u0131yla y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015ftur. \u201cTrafik denetimlerinde; denetim \u00f6ncesi, denetim an\u0131 ve sonras\u0131nda, trafik kazalar\u0131nda ise; kaza mahalline intikal ve sonras\u0131nda yap\u0131lacak i\u015f ve i\u015flemlerin usul ve esaslar\u0131 ile trafi\u011fi y\u00f6netme ve d\u00fczenleme hareketlerini belirlemek\u201d amac\u0131yla \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<br>Y\u00f6nergenin;<br>\u201cRadarla h\u0131z denetiminde dikkat edilecek husususlar\u201d ba\u015fl\u0131kl\u0131 34. maddesinin 1. f\u0131kras\u0131n\u0131n (\u00e7) bendinde \u015fu kurala yer verilmi\u015ftir ,<br>\u201cSabit denetim yap\u0131lmas\u0131 durumunda radar arac\u0131, karayolunun her iki y\u00f6n\u00fcnden kolayca g\u00f6r\u00fclebilecek ve trafi\u011fi tehlikeye d\u00fc\u015f\u00fcrmeyecek \u015fekilde konu\u015fland\u0131r\u0131l\u0131r.\u201d<br>\u201cYol kullan\u0131c\u0131lar\u0131n\u0131n bilgilendirilmesi\u201d ba\u015fl\u0131kl\u0131 47 nci maddesi aynen a\u015fa\u011f\u0131daki \u015fekildedir:<br>\u201c(1)Trafik kurallar\u0131na uyma d\u00fczeyini artt\u0131rmak, trafik g\u00fcvenli\u011fini sa\u011flamak ve yol kullan\u0131c\u0131lar\u0131n\u0131 bilgilendirip, bilin\u00e7lendirmek amac\u0131yla, denetimin karayolunun hangi kesimlerinde, hangi s\u00fcrelerde yap\u0131laca\u011f\u0131 ve hangi konularda yo\u011funla\u015ft\u0131r\u0131laca\u011f\u0131 ve bunlarla ilgili risk bilgileri, neden-sonu\u00e7 ili\u015fkileri ve denetim sonu\u00e7lar\u0131n\u0131n a\u00e7\u0131klanmas\u0131nda ulusal ve yerel medya ile di\u011fer ileti\u015fim ara\u00e7lar\u0131ndan azami \u00f6l\u00e7\u00fcde faydalan\u0131l\u0131r.\u201d<br>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 bu Y\u00f6nerge h\u00fckm\u00fcyle \u201ctrafik kurallar\u0131na uyma d\u00fczeyini artt\u0131rmak, trafik g\u00fcvenli\u011fini sa\u011flamak ve yol kullan\u0131c\u0131lar\u0131n\u0131 bilgilendirip, bilin\u00e7lendirmek\u201d amac\u0131yla trafik denetimlerinin;<br>&#8211; Karayolunun hangi kesimlerinde ve hangi s\u00fcrelerde yap\u0131laca\u011f\u0131,<br>&#8211; Hangi konularda yo\u011funla\u015ft\u0131r\u0131laca\u011f\u0131,<br>Hususlar\u0131nda ulusal ve yerel medya ile di\u011fer ileti\u015fim ara\u00e7lar\u0131ndan azami \u00f6l\u00e7\u00fcde faydalan\u0131lmas\u0131n\u0131 \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr.<br>B\u00f6ylece, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 taraf\u0131ndan tesis edilmi\u015f olan bir d\u00fczenleyici idari i\u015flemle \u201ctrafik denetimlerinin karayolunun hangi kesimlerinde, hangi s\u00fcrelerde yap\u0131laca\u011f\u0131 ve hangi konularda yo\u011funla\u015ft\u0131r\u0131laca\u011f\u0131 hususlar\u0131nda ulusal ve yerel medya ile di\u011fer ileti\u015fim ara\u00e7lar\u0131ndan da azami \u00f6l\u00e7\u00fcde faydalan\u0131lmak suretiyle yol kullan\u0131c\u0131lar\u0131n\u0131n (\u00f6zellikle s\u00fcr\u00fcc\u00fclerin) bilgilendirilmesine\u201d ili\u015fkin bir d\u00fczenleme ihdas etti\u011fi g\u00f6r\u00fclmektedir.<br>S\u00f6z\u00fc edilen bu d\u00fczenlemelerin, Avrupa Konseyinin Bakanlar Komitesinin Bakan Temsilcileri toplant\u0131s\u0131nda kabul etti\u011fi yukar\u0131da g\u00fcn ve say\u0131s\u0131 yaz\u0131l\u0131 \u201ciyi idare konusundaki\u201d tavsiye karar\u0131n\u0131n 10. maddesinin 1. ve 2. f\u0131kra h\u00fck\u00fcmlerine uygun bulunmaktad\u0131r.<br>Y\u00f6nergenin 3152 say\u0131l\u0131 Kanunun 29 uncu maddesi h\u00fckm\u00fcne g\u00f6re \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131n\u0131n ba\u011fl\u0131 kurulu\u015flar\u0131 olan ve mahsus kanunlar\u0131 uyar\u0131nca da bu Bakanl\u0131\u011f\u0131n sevk ve idaresi alt\u0131nda bulunan genel kolluk kuvvetleri i\u00e7inde yer alan trafik zab\u0131tas\u0131n\u0131 ba\u011flad\u0131\u011f\u0131 da tart\u0131\u015fmas\u0131zd\u0131r.<br>Bu a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda somut olay\u0131n de\u011ferlendirilmesine gelince:<br>Y\u00f6nergenin 34\/1-\u00e7 ve 47 nci maddesi h\u00fck\u00fcmleri kar\u015f\u0131s\u0131nda \u201cradarla h\u0131z denetiminin karayolunun hangi kesiminde ve hangi s\u00fcrelerde yap\u0131laca\u011f\u0131\u201d hususunda yol kullan\u0131c\u0131lar\u0131n\u0131n bilgilendirilmesi gerekti\u011fi kabul edilmelidir. Bu husus ayn\u0131 zamanda Avrupa Konseyinin Bakanlar Komitesinin Bakan Temsilcileri taraf\u0131ndan kabul edilen tavsiye karar\u0131n\u0131n iyi idare ilkelerinden olarak kabul edilen \u201ca\u00e7\u0131kl\u0131k ve uygun ara\u00e7larla haberdar etme\u201d ilkelerinin de bir gere\u011fidir.<br>Y\u00f6nergenin 47 nci maddesi h\u00fckm\u00fcne g\u00f6re, idare bu bilgilendirme faaliyetinde \u201culusal ve yerel medya ile di\u011fer ileti\u015fim ara\u00e7lar\u0131ndan\u201d azami \u00f6l\u00e7\u00fcde faydalanacakt\u0131r. \u0130darenin \u201cyol kullan\u0131c\u0131lar\u0131n\u0131 her ko\u015fulda bilgilendirmek\u201d ile y\u00fck\u00fcml\u00fc tutuldu\u011fu, bu ama\u00e7la \u201culusal ve yerel medya ile di\u011fer ileti\u015fim ara\u00e7lar\u0131nda da azami \u00f6l\u00e7\u00fcde yararlanma cihetine gidebilece\u011fi sonucuna var\u0131lmas\u0131 gerekmektedir. \u0130dare \u00f6ncelikle kendi mutat vas\u0131ta ve y\u00f6ntemleriyle bilgilendirme yapacakt\u0131r. Zira \u201ckarayolundan yararlananlara, yol, trafik durumu ve yak\u0131n \u00e7evre ile ilgili gerekli bilgileri vermek, yasaklama ve k\u0131s\u0131tlamalar\u0131 bildirmek suretiyle trafik d\u00fczen ve g\u00fcvenli\u011fini sa\u011flamak amac\u0131na y\u00f6nelik olarak karayollar\u0131nda uygulanacak trafik i\u015faretlerinin, standart, anlam, nicelik ve nitelikleri ile di\u011fer esaslar\u201d, 19.06.1985 tarihli ve 18789 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan Trafik \u0130\u015faretleri Hakk\u0131nda Y\u00f6netmelik ile d\u00fczenlenmi\u015ftir. Dolay\u0131s\u0131yla, Trafik Denetimlerinde ve Trafik Kazalar\u0131nda Al\u0131nacak \u00d6nlemlere \u0130li\u015fkin Y\u00f6nergenin 47 nci kapsam\u0131ndaki bilgilendirmenin, bu Y\u00f6netmelikteki usul ve esaslara g\u00f6re konulacak \u201ctrafik i\u015faret levhalar\u0131\u201d ile yap\u0131lmas\u0131 gerekmektedir. Bu y\u00f6ntem d\u0131\u015f\u0131nda gerekiyorsa medya ve di\u011fer ileti\u015fim ara\u00e7lar\u0131ndan da yararlanacakt\u0131r.
