Say\u0131l\u0131 Karar\u0131:<\/p>\n\n\n\n<p>Mahkemesi:Asliye Hukuk Mahkemesi<br>Yukar\u0131da tarih ve numaras\u0131 yaz\u0131l\u0131 bozmaya uyularak verilen h\u00fck\u00fcm taraf vekillerince temyiz edilmi\u015f, davac\u0131 vekili taraf\u0131ndan duru\u015fma istenmi\u015f olmakla duru\u015fma i\u00e7in tayin edilen g\u00fcnde davac\u0131 vekili Avukat &#8230; geldi. Daval\u0131 vekili gelmedi. Temyiz dilek\u00e7elerinin s\u00fcresi i\u00e7inde verildi\u011fi anla\u015f\u0131ld\u0131ktan ve haz\u0131r bulunan davac\u0131 avukat\u0131 dinlendikten sonra vaktin darl\u0131\u011f\u0131ndan \u00f6t\u00fcr\u00fc i\u015fin incelenerek karara ba\u011flanmas\u0131 ba\u015fka g\u00fcne b\u0131rak\u0131lm\u0131\u015ft\u0131. Bu kere dosyadaki ka\u011f\u0131tlar okunduktan sonra i\u015fin gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br>K A R A R &#8211;<br>Dava, kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinden kaynaklanan tapu ipt\u00e2l tescil, alacak ve menfi tespit talebine ili\u015fkin olup mahkemece davan\u0131n k\u0131smen kabul\u00fcne dair verilen karar taraflarca temyiz edilmi\u015ftir.<br>1-Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 delillerle yasaya uygun gerektirici nedenlere ve \u00f6zellikle delillerin takdirinde bir isabetsizlik bulunmamas\u0131na g\u00f6re daval\u0131n\u0131n t\u00fcm, davac\u0131n\u0131n a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131nda kalan di\u011fer temyiz itirazlar\u0131n\u0131n reddi gerekmi\u015ftir.<br>2-Davac\u0131 davas\u0131nda daval\u0131 ile aralar\u0131nda 21.09.2004 tarihli kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin d\u00fczenlendi\u011fini, buna g\u00f6re 410 m\u00b2 y\u00fcz\u00f6l\u00e7\u00fcml\u00fc arsas\u0131na kar\u015f\u0131l\u0131k daval\u0131n\u0131n yapaca\u011f\u0131 binada br\u00fct 175 m\u00b2&#8217;lik 2 adet dairenin verilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, s\u00f6zle\u015fmenin 2. maddesinde 2 y\u0131l i\u00e7erisinde in\u015faata ba\u015flanmad\u0131\u011f\u0131 takdirde s\u00f6zle\u015fmenin h\u00fck\u00fcms\u00fcz say\u0131laca\u011f\u0131, 6. maddesinde ise in\u015faat\u0131n ba\u015flang\u0131\u00e7 ve biti\u015f s\u00fcrelerinin, 11. maddesinde de ceza-i sorumluluklar\u0131n h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131n\u0131, daval\u0131n\u0131n dairelerine kararla\u015ft\u0131r\u0131lan s\u00fcrede teslim etmedi\u011fini, 28.11.2007 tarihinde adi \u015fekilde d\u00fczenlenen s\u00f6zle\u015fmede daire say\u0131s\u0131n\u0131n 3&#8217;e \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131, kendisine iki dairenin gecikmeli olarak teslim edildi\u011fini ancak bir dairenin teslim edilmedi\u011fini, 28.11.2007 tarihli s\u00f6zle\u015fmede 15.06.2006 tarihinden itibaren tapular\u0131n teslim tarihine kadar kira \u00f6denece\u011finin yaz\u0131l\u0131 oldu\u011funu, gerek ge\u00e7 teslim edilen 2 daire, gerekse de teslim edilmeyen 3. daire i\u00e7in kendisine kira \u00f6demesi yap\u0131lmad\u0131\u011f\u0131n\u0131, daval\u0131ya 3 daire teslim etmesi kar\u015f\u0131l\u0131\u011f\u0131nda verilen 30.02.2008 ke\u015fide tarihli 29.000 Euro bedelli teminat senedini de verdi\u011fini belirterek teslim edilmeyen dairenin tapusunun ipt\u00e2li ile ad\u0131na tapuya kay\u0131t ve tesciline, m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde mahkemece alacakl\u0131 oldu\u011fu miktar\u0131n belirlenmesine, 3. dairenin teslimi halinde \u00f6denmesi gereken 29.000 Euro&#8217;nun mahsubu ile fazlaya ili\u015fkin haklar\u0131 sakl\u0131 kalmak kayd\u0131yla \u015fimdilik 15.000.00 TL&#8217;nin daval\u0131dan tahsiline, 30.02.2008 tarihli ve 29.000 Euro bedelli teminat senedinin bedelsizli\u011fine karar verilmesini talep etmi\u015ftir.Daval\u0131 savunmas\u0131nda 21.09.2004 tarihli kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinde davac\u0131n\u0131n 410 m\u00b2&#8217;lik arsas\u0131na kar\u015f\u0131l\u0131k 2 daire verilmesinin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, sonraki adi s\u00f6zle\u015fmelerin ge\u00e7ersiz oldu\u011funu, davac\u0131n\u0131n 2 daireyi kay\u0131ts\u0131z \u015farts\u0131z teslim ald\u0131\u011f\u0131 ve itiraz ileri s\u00fcrmedi\u011fine g\u00f6re ge\u00e7mi\u015f i\u00e7in kira bedeli talep edemeyece\u011fini a\u00e7\u0131klayarak davan\u0131n reddine karar verilmesini istemi\u015ftir.<br>Mahkemece davac\u0131n\u0131n kat kar\u015f\u0131l\u0131\u011f\u0131 s\u00f6zle\u015fmeye g\u00f6re dairelerini teslim ald\u0131\u011f\u0131, sonradan d\u00fczenlenen adi s\u00f6zle\u015fmelerin ge\u00e7erli olmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n k\u0131smen kabul\u00fc ile davac\u0131n\u0131n tapu ipt\u00e2li tescil tazminat ve ifaya ekli kira alaca\u011f\u0131na y\u00f6nelik cezai \u015farta ili\u015fkin istemlerinin reddine, 30.02.2008 tarihli 29.000 Euro bedelli teminat senedi y\u00f6n\u00fcnden davac\u0131 taraf\u0131n daval\u0131 tarafa bor\u00e7lu bulunmad\u0131\u011f\u0131n\u0131n tespitine karar verilmi\u015ftir.Taraflar aras\u0131nda 21.09.2004 tarihli resmi \u015fekilde kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin d\u00fczenlendi\u011fi ihtil\u00e2fs\u0131z olup bu s\u00f6zle\u015fmede davac\u0131ya ait arsada yap\u0131lacak binada davac\u0131ya her biri 175 m2 iki dairenin verilmesi, 2. maddesinde in\u015faat\u0131n iki y\u0131l i\u00e7inde bitirilmemesi halinde s\u00f6zle\u015fmenin ge\u00e7ersiz say\u0131laca\u011f\u0131n\u0131n kabul edilip 6. maddesinde t\u00fcm arsa sahipleri taraf\u0131ndan gerekli vek\u00e2letnamelerin verilmesinden sonra 42 ayda in\u015faat\u0131n tamamlanaca\u011f\u0131n\u0131n, 11. maddesinde s\u00f6zle\u015fmeye uymayan taraf\u0131n di\u011fer taraf\u0131n zararlar\u0131n\u0131 \u00f6deyece\u011finin kabul edildi\u011fi anla\u015f\u0131lmaktad\u0131r. Yine taraflar aras\u0131nda adi \u015fekilde d\u00fczenlenen 28.11.2007 tarihli ek s\u00f6zle\u015fmede davac\u0131ya 3 dairenin verilip 15.06.2006 tarihinden itibaren arsa sahibine kira \u00f6denece\u011finin kabuul edildi\u011fi, 30.02.2008 tarihli adi s\u00f6zle\u015fmede de 15.06.2007 tarihinden itibaren 2000 Euro, temel at\u0131ld\u0131ktan sonra 2500 Euro kira \u00f6denmesinin kabul edildi\u011fi g\u00f6r\u00fclmektedir. Mahkemenin de kabul\u00fcnde oldu\u011fu \u00fczere, taraflar aras\u0131nda d\u00fczenlenen 28.11.2007 ve 30.02.2008 tarihli adi s\u00f6zle\u015fmeler ge\u00e7erli 21.09.2004 tarihli resmi kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinde kararla\u015ft\u0131r\u0131lan edimler itibariyle, taraflar\u0131n durumlar\u0131n\u0131 a\u011f\u0131rla\u015ft\u0131r\u0131c\u0131 ve yeni bor\u00e7lar y\u00fckleyici nitelikte olup, resmi \u015fekilde yap\u0131lmas\u0131 zorunlu iken adi \u015fekilde yap\u0131lmas\u0131 nedeniyle ge\u00e7ersizdir. Ancak, davac\u0131 arsa sahibinin resmi s\u00f6zle\u015fmede gecikme tazminat\u0131 belirlenmemi\u015f olsa dahi en az ayl\u0131k rayi\u00e7 kira seviyesinde gecikme tazminat\u0131n\u0131 istemesi m\u00fcmk\u00fcnd\u00fcr. Bu nedenle, mahkemece davac\u0131n\u0131n kendisine ge\u00e7 teslim edildi\u011fini iddia etti\u011fi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri ile ilgili olarak 21.09.2004 tarihli s\u00f6zle\u015fmeye g\u00f6re in\u015faat\u0131n bitmesi gereken tarihin ara\u015ft\u0131r\u0131l\u0131p belirlenerek, varsa davac\u0131n\u0131n teslim ald\u0131\u011f\u0131 tarihe kadar rayi\u00e7 kira bedellerinin bilirki\u015filerden al\u0131nacak ek rapor ile hesaplatt\u0131r\u0131l\u0131p, taleple ba\u011fl\u0131 kalmak kayd\u0131yla karar verilmesi gerekirken, tazminat talebinin t\u00fcm\u00fcyle reddine karar verilmesi do\u011fru olmam\u0131\u015f, bozulmas\u0131 gerekmi\u015ftir.SONU\u00c7: Yukar\u0131da 1. bentte a\u00e7\u0131klanan nedenlerle daval\u0131n\u0131n t\u00fcm, davac\u0131n\u0131n di\u011fer temyiz itirazlar\u0131n\u0131n reddine, 2. bentte a\u00e7\u0131klanan nedenlerle karar\u0131n temyiz eden davac\u0131 yarar\u0131na BOZULMASINA, 2.540,00 TL duru\u015fma vek\u00e2let \u00fccretinin daval\u0131dan al\u0131narak Yarg\u0131tay&#8217;daki duru\u015fmada vekille temsil olunan davac\u0131ya verilmesine, \u00f6denenden 5766 say\u0131l\u0131 Kanun&#8217;un 11. maddesi ile yap\u0131lan de\u011fi\u015fiklik gere\u011fince Har\u00e7lar Kanunu 42\/2-d maddesi uyar\u0131nca al\u0131nmas\u0131 gereken 218,50 TL Yarg\u0131tay ba\u015fvurma harc\u0131n\u0131n mahsup edilerek, varsa fazla al\u0131nan temyiz harc\u0131n\u0131n temyiz eden davac\u0131ya iadesine, a\u015fa\u011f\u0131da yaz\u0131l\u0131 bakiye 4.724,50 TL temyiz ilam harc\u0131n\u0131n temyiz eden daval\u0131dan al\u0131nmas\u0131na, karara kar\u015f\u0131 tebli\u011f tarihinden itibaren 15 g\u00fcn i\u00e7inde karar d\u00fczeltme isteminde bulunulabilece\u011fine 17.02.2020 g\u00fcn\u00fcnde oybirli\u011fiyle karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yarg\u0131tay 15.
