Say\u0131l\u0131 Karar\u0131:<\/p>\n\n\n\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n\n\n\n<p>MAHKEMES\u0130 :SULH HUKUK MAHKEMES\u0130<br>Taraflar aras\u0131ndaki kira bedelinin tespiti davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde davac\u0131 taraf\u0131ndan temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br>Y A R G I T A Y K A R A R I<br>Davac\u0131; daval\u0131n\u0131n 15.02.2010 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile kirac\u0131s\u0131 oldu\u011funu, kira bedelinin emsallerin alt\u0131nda kald\u0131\u011f\u0131n\u0131 belirterek ayl\u0131k 760,00 TL olan kira bedelinin 15.02.2015 tarihinden itibaren ayl\u0131k 1.000,00 TL olarak tespitine karar verilmesini istemi\u015ftir.<br>Daval\u0131, talep edilen miktar\u0131n iyi niyete ayk\u0131r\u0131 olup \u00dcFE oran\u0131n\u0131n \u00fczerinde kald\u0131\u011f\u0131n\u0131 belirterek davan\u0131n reddine karar verilmesini istemi\u015ftir.<br>Mahkemece; davan\u0131n k\u0131smen kabul\u00fc ile ayl\u0131k kira bedelinin 15.02.2015 tarihi itibari ile 900,00-TL olarak tespitine, %10 hak ve nefaset indirimi yap\u0131larak ta\u015f\u0131nmaz\u0131n ayl\u0131k kiras\u0131n\u0131n 15.02.2015 tarihi itibari ile 810,00-TL net kira olarak tespitine karar verilmi\u015f; s\u00f6z konusu karar davac\u0131 taraf\u0131ndan temyiz edilmi\u015ftir.<br>Hak ve nesafete uygun kira belirlenirken ta\u015f\u0131nmaz\u0131n yeniden kiralanmas\u0131 halinde serbest \u015fartlarda bo\u015f olarak kiraya verilmesi halinde getirebilece\u011fi kira bedelinden mahkemece hak ve nesafet kurallar\u0131na uygun indirim yap\u0131larak kira bedelinin tespiti gerekir. H\u00fckme esas al\u0131nan 04.03.2016 tarihli bilirki\u015fi raporunda daval\u0131n\u0131n eski kirac\u0131 oldu\u011fu da de\u011ferlendirilerek indirim uygulanmak suretiyle kira bedelinin hak ve nesafete g\u00f6re belirlendi\u011fi anla\u015f\u0131lmakta olup, Mahkemece ikinci kez indirim uygulanarak kira bedelinin belirlenmi\u015f olmas\u0131 do\u011fru de\u011fildir. Bu durumda Mahkemece \u00f6ncelikle bilirki\u015fi kurulundan h\u00fck\u00fcm kurmaya yeterli ve denetime elveri\u015fli bir \u015fekilde ek rapor al\u0131narak, ta\u015f\u0131nmaz\u0131n bo\u015f olarak yeniden kiraya verilmesi halinde getirebilece\u011fi br\u00fct kira bedelinin belirlenmesi, daha sonra Mahkemece bu bedelden daval\u0131n\u0131n eski kirac\u0131 oldu\u011fu g\u00f6zetilerek %10-20 oran\u0131nda hakkaniyete uygun bir miktarda indirim yap\u0131ld\u0131ktan sonra kira bedelinin br\u00fct olarak tespiti gerekirken, yetersiz bilirki\u015fi raporuna g\u00f6re yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm kurulmas\u0131 usul ve yasaya ayk\u0131r\u0131 olup bozmay\u0131 gerektirmi\u015ftir.<br>Ayr\u0131ca; h\u00fck\u00fcm f\u0131kras\u0131n\u0131n hak ve nesafet indirimi uygulanarak belirlenen bedel \u00fczerinden kurulmas\u0131 gerekirken, infazda teredd\u00fct yaratacak \u015fekilde ayl\u0131k kira bedelinin 15.02.2015 tarihi itibari ile 900,00-TL olarak tespitine karar verildikten sonra ikinci bent olarak %10 hak ve nefaset indirimi yap\u0131larak ta\u015f\u0131nmaz\u0131n ayl\u0131k kiras\u0131n\u0131n 15.02.2015 tarihi itibari ile 810,00-TL net kira olarak tespitine karar verilmesi de do\u011fru de\u011fildir.<br>SONU\u00c7: Yukar\u0131da a\u00e7\u0131klanan nedenlerle a\u00e7\u0131klanan nedenlere h\u00fckm\u00fcn HUMK.nun 428. maddesi gere\u011fince davac\u0131 yarar\u0131na BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde temyiz edene iadesine, 6100 say\u0131l\u0131 HMK&#8217;nun ge\u00e7ici madde 3 atf\u0131yla 1086 say\u0131l\u0131 HUMK.nun 440.maddesi gere\u011fince karar d\u00fczeltme yolu kapal\u0131 olmak \u00fczere, 13\/02\/2019 tarihinde oy birli\u011fiyle karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yarg\u0131tay 3.
